1. About Us
Derry Digital is a web design studio based in Derry, Northern Ireland. By engaging our services or using this website you agree to these terms. Contact us at info@derrydigital.co.uk.
2. Services
We provide web design, web development, branding, and SEO services. The specific scope, deliverables, timeline, and pricing for each project are agreed in writing before work begins. These terms apply to all engagements unless superseded by a separate written agreement.
3. Payment
- A deposit is required before work commences. The deposit amount will be agreed at project sign-off.
- The remaining balance is due on completion and prior to the website going live.
- Monthly retainer fees (hosting, maintenance, ongoing services) are billed in advance.
- Late payments may result in work being paused or services being suspended.
4. Client Responsibilities
To deliver your project on time, we require:
- Timely provision of content, images, and feedback
- A designated point of contact for approvals
- Access to required accounts (domain, hosting, third-party services) as needed
Delays caused by the client may affect the project timeline. We are not liable for delays outside our control.
5. Intellectual Property
- Upon receipt of full payment, the client owns the final website design and content.
- We retain the right to display completed work in our portfolio unless otherwise agreed in writing.
- Third-party assets (stock images, fonts, plugins) remain subject to their respective licences.
6. Revisions
Each project includes a reasonable number of revision rounds as agreed at project start. Significant changes to scope or direction may be treated as additional work and quoted separately.
7. Limitation of Liability
We make every effort to deliver high-quality work. However, we are not liable for:
- Loss of revenue or business resulting from website downtime or errors
- Issues caused by third-party services, hosting providers, or domain registrars
- Content provided by the client that infringes third-party rights
Our total liability in any circumstance is limited to the fees paid for the specific project in question.
8. Termination
Either party may terminate a project engagement with written notice. Work completed up to the point of termination will be invoiced. Deposits are non-refundable once work has commenced.
9. Governing Law
These terms are governed by the laws of Northern Ireland and the United Kingdom. Any disputes will be subject to the exclusive jurisdiction of the courts of Northern Ireland.
10. Changes to These Terms
We may update these terms from time to time. The date at the top of this page reflects the most recent revision. Continued use of our services constitutes acceptance of the updated terms.
